
A misconduct hearing is to be held between 25th and 29th September, 2023, at Lincolnshire Police Headquarters at Nettleham.
It is alleged that Detective Superintendent Richard Myszczyszyn breached the following standards of professional behaviour:
- Honesty and Integrity
- Authority, Respect and Courtesy
- Orders and Instructions
- Confidentiality
- Discreditable conduct
D/Supt Myszczyszyn is stationed at Force Headquarters.
It is alleged that between July, 2020 and April, 2022, the officer breached Standards of Professional Behaviour:
In February, 2021, he accessed police systems and viewed the personal data of individuals without a policing purpose and or in contravention of Lincolnshire Police Misuse of Police Systems policy.
Between May and July, 2021, he accessed a police system in respect of the personal data of others which was other than in accordance with a policing purpose and/or in contravention of Lincolnshire Police Misuse of Police Systems policy.
In September, 2022, entered a supermarket whilst off duty and identified himself as a police officer, misled an individual by telling them that they were investigating an allegation of harassment when they knew or ought to have known that they were not acting in a professional capacity or investigating an allegation and further, or alternatively, failed to be open and honest with an individual by not disclosing that they were personally connected to the individuals involved in the alleged incident and that they were not acting in their official capacity as a police officer when making a request and/or directing them to provide access to CCTV footage.
In September, 2022, used a personal mobile device to record extracts of CCTV footage, thus obtaining personal data, other than in accordance with a policing purpose.
The conduct, if proved, amounts to gross misconduct.
Detective Superintendent Myszczyszyn is Head of CID and Investigative Standards at Lincs Police a post to which he was appointed in April, 2023. He is highly qualified in that role having attainted PIP4 qualification.
He has over 20 years police service and was educated in Skegness.
On his LinkedIn profile he says: “I am a strategic leader in risk management and public safety, delivering operational excellence through partnership working and embedding a culture of continuous improvement, with over 20 years of law enforcement experience.
“Throughout my career, I have developed a reputation as a trusted and results-oriented leader, with expertise in safeguarding, risk management, project management, partnership working, and investigations.
“My passion for safeguarding is evident in my work in the investigation and prosecution of serious and complex crimes, including those involving vulnerable and high-risk individuals, and I have developed and implemented effective strategies to prevent and respond to crimes, to protect individuals and communities, supporting victims and witnesses through the criminal justice system.”
Lincolnshire Police has not named the Legally Qualified Chair who will lead the Panel of three hearing the allegations. The length of hearing – five days – indicate that the senior detective at the centre of them will be defending his actions.
