The purge of rogue officers from its ranks by West Yorkshire Police continues apace.

Beginning today (28th September, 2023), three of its officers face misconduct hearings in which alleged violent conduct is a feature in all of them.

1, Former PC 2579 Jacob Swallow will attend at a misconduct hearing on 28th September, 2023 at 10am over allegedly breaching the Standards of Professional Behaviour in relation to:

Authority, Respect and Courtesy
Use of Force
Discreditable Conduct.

On 15 June 2022, PC Swallow attended an incident outside an address in Keighley. On arrival, a 17-year-old male was located and due to his behaviour, he was handcuffed and taken inside a police van. Whilst in the police van, the male began banging his head against the cage door and attempts were made to calm him down.

It is alleged that PC Swallow opened the caged door and struck the male to the head/face area, causing facial injuries.

PC Swallow was subsequently charged with an offence of Assault by Beating, contrary to s39 of the Criminal Justice Act 1988 and on 30 March 2023, was found guilty of those charges at York Magistrates Court.

2, A Gross Misconduct Hearing is to be held on 2-3 October 2023, commencing at 09:30hrs, at West Yorkshire Police Headquarters, Laburnum Road, Wakefield, concerning Police Constable 4788 Manjit Chahal.

It is alleged that:

(i) On 18 July 2021, whilst off duty, PC Chahal was involved in an incident that resulted in police attendance.

(ii) CCTV shows him in a physical altercation with another male inside McDonalds at Leeds train station. During the altercation he punched the other male and he was subsequently removed from McDonalds by security staff.

(iii) A further physical altercation took place on the railway concourse involving PC Chahal, his friend and the other male. PC Chahal continued to fight with the male and punched the male on numerous occasions during the incident.

(iv) When British Transport Police attended, PC Chahal was uncooperative and challenging and refused to provide his details which resulted in him being arrested.

(v) PC Chahal was argumentative and abusive and accused the officers of being racist.

In behaving in such a way, it is alleged that PC Chahal has acted in breach of the Standards of Professional Behaviour relating to Discreditable Conduct and Authority, Respect and Courtesy.

3, On 4th -6th October 2023 commencing at 10:00hrs on day one, a Gross Misconduct Hearing will take place at West Yorkshire Police Headquarters, Laburnum Road, Wakefield, concerning Detective Constable Andrew Shaw.

It is alleged that:-

(i) On 6th June 2021, he returned home with his wife after an afternoon drinking at his local club.

(ii) An argument ensued which culminated in him punching his wife, causing her to fall to the floor and sustain a proximal humoral fracture to her right humerus.

(iii) He then went upstairs with a box of wine and left his wife on the floor without seeking medical attention for her. She then rang the emergency services.

(iv) When officer’s attended and DC Shaw was arrested, he was uncooperative and challenging resulting in it being necessary to handcuff him to take him safely into custody.

In behaving in such a way, DC Shaw is alleged to have acted in breach of the Standards of Professional Behaviour relating to Discreditable Conduct.

West Yorkshire Police routinely publishes information about public misconduct or special case hearings on its website. Misconduct hearings deal with allegations of gross misconduct by police officers or special constables.

All misconduct or special case hearings are held in public in accordance with the 2015 legislation to improve transparency and accountability and ensure public confidence. There may be certain circumstances when it will be necessary and appropriate for all or parts of a hearing to be held in private. The identity of victims/witnesses will be protected during those hearings as appropriate.
